Introduction

Spect AI, Inc. (dba Nonlinear) (“Nonlinear,” “we,” “our,” or “us”) provides a no-code AI workflow platform that allows Architecture, Engineering, and Construction (AEC) teams to automate document-related processes. We respect your privacy and are committed to protecting your personal information.

This Privacy Policy explains what data we collect, how we use it, and your rights.

Information We Collect

We may collect the following types of information when you use our services:

• Account Information: Name, email address, company, and login credentials.
• SMS Messaging Information: Mobile phone number, SMS opt-in and opt-out preferences, consent date and method, and message delivery records if you enroll in SMS workflow notifications.
• Usage Information: Interactions with our platform (e.g., workflows created, features used, error logs).
• Document Data: Files you upload (e.g., specs, spreadsheets, submittals) to build or use workflows.
• Technical Data: Device information, IP address, browser type, operating system, and cookies.
• Support Communications: Any information you provide when contacting us for support or feedback.
• Authentication Data: We use a secure third-party authentication provider (Clerk) to manage user sign-in and account creation. Nonlinear does not store your passwords or other authentication secrets; these are securely managed by Clerk in accordance with their security and compliance policies.

How We Use Information

We use collected information to:

• Provide, operate, and improve our services.
• Develop new features and AI capabilities.
• Personalize your experience and improve usability.
• Communicate with you regarding updates, billing, and technical support.
• Send optional SMS workflow notifications to users who have expressly opted in, and manage consent and unsubscribe preferences.
• Detect and prevent fraud, abuse, or security threats.
• Comply with legal obligations.

Where required by law, we process personal information on the basis of one or more of the following:

• your consent,
• performance of a contract,
• compliance with a legal obligation, or
• our legitimate interest in operating and improving our services.

For account management and billing information, Nonlinear acts as a data controller. For Customer Data uploaded to our platform, Nonlinear acts as a data processor/service provider on behalf of the customer.

Sharing of Information

We do not sell or rent your personal information. We may share data only with:

• Service Providers that help us operate our business (e.g., authentication on Clerk, file storage on Amazon Web Services S3, cloud hosting on Render, cookieless analytics on PostHog, support, and email communication tools).
  These subprocessors act solely on our behalf, are bound by strict confidentiality and data protection obligations, and are not permitted to use your data for any other purpose.
• Integration Partners you authorize, if you connect Nonlinear to third-party applications.
• Legal and Compliance purposes when required by law, regulation, or to protect rights, property, or safety.

All the above categories exclude text messaging originator opt-in data and consent; this information won’t be shared with any third parties.

SMS Workflow Notifications

The Nonlinear Workflow Notifications SMS program is operated by Spect AI, Inc. (dba Nonlinear). If you choose to enroll, we use your mobile number and messaging preferences to send automated, non-promotional notifications about the progress and completion of workflows you initiate in your account, including Estimator Scrub executions.

SMS enrollment is optional. Accepting our Terms of Service or Privacy Policy, creating an account, or providing a phone number does not by itself enroll you. SMS consent is collected separately through an unchecked checkbox that you actively select. You can use Nonlinear without enrolling in SMS notifications.

We use messaging information to deliver requested notifications, record consent, manage your messaging preferences, and honor unsubscribe requests. We do not share mobile information with third parties or affiliates for marketing or promotional purposes. We do not sell, rent, or transfer SMS opt-in data or consent.

We use messaging service providers, such as Twilio, to deliver SMS notifications on our behalf. Mobile numbers and delivery information are processed only as needed to provide and secure the messaging service; these providers are not permitted to use that information for their own marketing or promotional purposes.

Message frequency varies based on your workflow activity. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help. For assistance, contact sheel@nonlinear.build. Additional program details are provided in our Terms of Service.

International Transfers

We are based in the United States. If you access our services from outside the U.S., your information may be transferred to and processed in the U.S. or other countries where our service providers operate. We take steps to ensure adequate safeguards, including the use of Standard Contractual Clauses (SCCs) where applicable.

Data Retention and Deletion

We retain data for as long as your account remains active or as necessary to provide services. Upon contract termination or your written request, we will delete or anonymize your data within a commercially reasonable period unless retention is required by law.

We retain SMS consent records and opt-out preferences for as long as needed to document consent, comply with applicable requirements, and prevent further messaging to users who have unsubscribed. Opting out stops notifications but does not automatically delete records needed to honor your request.

Security

We maintain industry-standard administrative, technical, and organizational safeguards to protect data, including:

• Encryption in transit and at rest
• Access controls and authentication
• Monitoring and vulnerability management
• Least-privilege principles for employee access

While we take reasonable measures to protect your information, no system is 100% secure.

Use of Aggregated and Anonymized Data

We may analyze usage patterns and content in aggregate or de-identified form to:

• improve and optimize our services, and
• develop new AI models or capabilities.

Nonlinear does not use identifiable Customer Data to train AI models that are shared across customers or made publicly available. Any model improvements or feature development are based only on aggregated or de-identified data, ensuring that information from one customer cannot be viewed, inferred, or reconstructed by another. If Nonlinear ever offers customer-specific model training or fine-tuning services, such activities will occur under a separate written agreement with explicit consent from the customer.

Your Rights

Depending on your location, you may have rights under applicable laws (such as the GDPR or CCPA) to:

• Access a copy of your personal data.
• Request correction or deletion of your data.
• Restrict or object to certain processing activities.
• Request data portability.

Children’s Privacy

Our services are not directed to children under 16. We do not knowingly collect personal data from children.

Updates to This Policy

We may update this Privacy Policy periodically. Updates will be posted with a new “Last Updated” date.
